The Zoning Hearing Board of New Garden Township, Chester County, Pennsylvania will hold two (2) Hearings on Tuesday, July 9, 2024, at 6:30 p.m., at the Township Building, 299 Starr Road, Landenberg, Pennsylvania, on the Applications of: (i) 141 Thompson Road, LLC; and (ii) Edward (Jr.) & Margaret Toland and Edward Toland, III & Bethany Dudash.


Applicant 141 Thompson Road, LLC is the equitable owner of approximately 75.056 acres of land, located at 141 and 160 Thompson Road, Kennett Square, PA 19348, identified as Tax Parcel I.D. No.: 60-2-78 and 60-2-82, respectively, located in the Township’s R-1 (Low Density Residential) Zoning District. Applicant is proposing to construct 51 single-family detached dwellings, among other improvements. Associated with this residential development, Applicant seeks dimensional variance relief from New Garden Township Zoning Ordinance Sections 200-106.A(5) and 200-106.B(1), which provides that illumination for pedestrian walkways must maintain a 0.5 average footcandle and a uniformity ratio of 5:1. Therefore, 68 lighting fixtures are required on the property, whereas Applicant proposes a total of six (6).


Applicants Edward (Jr.) & Margaret Toland and Edward Toland, III & Bethany Dudash are the equitable owners of approximately 1.0 acres of land, located at 502 Kelleher Drive, Landenberg, PA 19350, identified as Tax Parcel I.D. No.: 60-5-29.18, located in the Township’s R-1 (Low Density Residential) Zoning District. Applicants seeks to purchase the property and reside in the existing house and in-law suite. In order to do so, Applicants require a variance from New Garden Township Zoning Ordinance Section 200-18.A. to permit the use of the home’s existing in-law suite.
